2013 Wahl Man of the Year Contest Official Rules

Contest Description
The 2013 WAHL Man of the Year Contest ("Contest") begins May 17, 2013 at 12:00 PM Central Time ("CT") and ends October 28, 2013 at 5:00 PM CT (the "Promotion Period"). Men 18 years of age or older will have the opportunity to submit a creative photo showing off their "well groomed" facial hair and answer a series of questions.
Elgibility
Entrants must be male, 18 years of age or older at time of entry, and must be legal residents of the fifty (50) United States and the District of Columbia. This Contest is void where prohibited by law. To be eligible, entrants must have facial hair at the time of entry; winners of any prior WAHL Man of the Year Contest (including Man of the Market prize winners and Man of the Year prize winners) are ineligible to enter or win any prize in this Contest. Employees, officers and directors of WAHL Clipper Corporation ("Sponsor") and its parent company, affiliates, subsidiaries, advertising and promotional agencies, and members of their immediate families (spouse and parent, children and siblings, and their respective spouses, regardless of where they reside), and persons living in the same household (whether or not related) of such employees are ineligible to enter or win. By participating, entrant agrees to these Official Rules, and the decisions of the Sponsor and/or its independent judges, which are final and binding in all respects.
TO ENTER: There are two (2) ways to enter
- Online Entry: Go to www.wahlnation.com ("Web site") during the Promotion Period, click on the icon, banner or text link to access the Contest registration page, and then follow the directions to enter the Contest. You will need to complete the entry form fully and accurately by 1) entering your full name, address, daytime phone, email address and date of birth, 2) answering a short questionnaire, and 3) uploading your creative photo showing off your "well groomed" facial hair (collectively, with entry form, an "Entry"). The photo you submit must be a photo of you, must be a full frontal photo of your entire head (head, neck, and shoulders only), may not have your face or head obscured in any way by any objects other than your facial hair (e.g., sunglasses and/or a hat), must be in .JPG format, and may not be larger than 3 MB in size. All entries must be received and recorded by Sponsor's computer (the official Contest time keeping device) by 5:00 PM CT on October 28 2013 to be considered.

“Wahl MobileTour” Event Entry: You will also be able to enter in person during 14 scheduled "Wahl Mobile Tour" events. Entrants must live within a 50 mile radius of the venue where the event is being held to be eligible to enter at that event. To view a detailed schedule of events, visit www.wahlnation.com.com. There will be a photo area at each event, as well as on-site entry forms (while supplies last). The requirements to submit a written entry at a scheduled event are the same as the requirements stated above for submitting an online entry.
Limit one (1) entry per person, regardless of method of entry. Entries received from any person in excess of the limitation will be void. Multiple, separate entries may be submitted from different individuals residing in the same household; however, only one (1) winner per household is allowed. In the event more than one person from a single household is selected as a potential winner, the independent judging panel will determine the winner. No forms of entry other than as stated in these Official Rules will be accepted.
Contest Entry Requirements: The following guidelines set by the Sponsor must be followed for an entry to be eligible:
- All Wahl Mobile Tour event entries must be legibly hand-written or typed, or they will not be considered in the Contest;

Photos:
- may not have been submitted in any other competition;
- may not have been published;
- must not be inappropriate, offensive, defamatory or obscene;
- must not infringe upon any third party's rights, including, but not limited to, copyright, patent or trademarks/trade names/logos, or rights of privacy or publicity;
- Entries must be the original and sole creation of the entrant, owned solely by the entrant, and must be a current photo of the entrant;
- Any entry, in the sole opinion of the judges and/or Sponsor, found to contain dangerous, harmful or objectionable content, or deemed to be inappropriate for publication or to otherwise violate any of the above requirements, will be deemed ineligible;
- Any additional materials mailed to Sponsor (such as photos, artwork, samples, etc.) will not be included in the judging process, nor will they affect, in any way, the outcome of the Contest;
- Photos cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic, or contain nudity;
- Photos cannot show or promote cruelty, harm, abuse or exploitation of anyone or anything;
- Photos cannot promote alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), promotes any activities that may appear unsafe or dangerous, or promotes any particular political agenda or message;
- Photos cannot be obscene or offensive, endorse any form of hate or hate group; appears to duplicate any other submitted entry.
- Photos must be in keeping with the Sponsor's image, and may not be offensive, nor can it defame, misrepresent or contain disparaging remarks about Sponsor or its products or other people, products or companies, as determined by Sponsor and the Contest Judges in their sole discretion.
- Photos cannot contain trademarks, logos or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission; or advertise or promote any brand or product of any kind, or contain any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
- Photos cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media), without permission.
- Photos cannot contain materials embodying the names, likeness, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission.
- Photos cannot consist of or contain look-alikes of celebrities or other public or private figures, living or dead;
- Photos cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate and/or
- Photos cannot violate any law.
All Entries, whether submitted online or at an event, will undergo screening for compliance with the guidelines and requirements set forth in these Official Rules. By submitting your Entry, you agree that your Entry conforms to these Official Rules and that Sponsor, in its sole discretion, may disqualify your Entry for any reason, including if it determines, in its sole discretion, that your Entry fails to conform to these Official Rules in any way or otherwise contains unacceptable content as determined by the Sponsor, in its sole discretion. Sponsor reserves the right not to post or, after posting, to remove, an Entry for any reason. Once your Entry has been submitted, you will not be permitted to change the Entry. The entry information provided is subject to WAHL's Privacy Policy. To read that Policy, access www.wahlnation.com and then click the "Privacy Policy" button. Entries become the property of Sponsor, and will not be acknowledged or returned.
Winner Selection/Voting
ROUND ONE: WAHL Man of the Market selections
All eligible Wahl Mobile Tour event Entries and online entries submitted by October 28, 2013 at 5:00 PM CT will be reviewed by an initial judging panel appointed by the Sponsor and consisting of employees of the Sponsor's design and marketing team to determine whether the Entry complies with these Official Rules and to score the Entry based on the judging criteria below. The judges' decisions are final and binding on all judging matters related to this Contest. The entrant with the highest scoring Entry in each Market will be declared the potential WAHL Man of the Market for that market. The entrant with the highest scoring Online Entry will also be declared a potential WAHL Man of the Market winner. After the verification process is completed, WAHL Man of the Market winners will be announced online at www.wahlnation.com.
ROUND TWO: WAHL Man of the Year Selection
WAHL Man of the Year Selection: Beginning on or about November 18, 2013 at 5:00:00 PM CT and ending on or about December 13, 2013 at 5:00:00 PM CT, all verified WAHL Man of the Market Entries selected in Round One who pass the background check will be judged by a second and different judging panel appointed by the Sponsor. The judges' decisions are final and binding on all judging matters related to this Contest. Judging will be based on the same weighted criteria as Round One. The WAHL Man of the Market with the highest scoring Entry will be declared the WAHL Man of the Year.
Judging Criteria
Judging for both rounds will be based on the following weighted criteria:
- Photo portrays "Well Groomed" Facial Hair (25%)
- Creativity & Uniqueness of Personal Style of the facial hair in the Photo (25%)
- Pride and enthusiasm for maintaining facial hair (based on answer to questionaire) (50%)
Background Check for Wahl Man of the Market
The WAHL Man of the Market winners must agree to a background check and to provide any information that Sponsor reasonably requests to conduct a background check, including Social Security number, and understand that no further notice is required to be provided to them by Sponsor with respect to such background check, and that Sponsor has the right, but not the obligation to conduct such background check prior to identifying a potential winner. Factors that may result in disqualification as a WAHL Man of the Market, in Sponsor's sole discretion, include, without limitation, negative driver history or record, any drug or alcohol dependency, criminal arrests or convictions, civil law suits alleging misconduct - either settled or still pending, and any other fact or allegation that, in Sponsor's reasonable discretion, would be inconsistent with the image, messages, and goodwill that Sponsor seeks to convey and be associated with, whether such facts are revealed to Sponsor in connection with a background check or otherwise. If a potential WAHL Man of the Market winner is disqualified for any reason, the entrant with the next highest scoring entry for the same market may be declared a potential WAHL Man of the Market winner for that market, or the Sponsor may elect not to designate a WHAL Man of the Market for that market.
Winner Notification and Claiming a Prize
Potential WAHL Man of the Market winners will be notified via mail, email or phone within approximately two (2) weeks of their selection. Potential WAHL Man of the Market winners will be required to verify their current mailing address, provide their Social Security number and submit a photocopy of a valid government issued photo ID (either driver's license or passport) as validation to verify he is the person in the photo.
WAHL Man of the Year Winner must complete, sign and return, within seven (7) days of the date of notification, an Affidavit of Eligibility including valid Social Security number and a Liability / Publicity Release (where lawful) and Federal Form W-9. As a condition of winning and qualifying for the prize, the potential WAHL Man of the Year Winner will be required to have facial hair at the time the prize is awarded. If the releases or any required documentation are not returned within seven (7) days, if any prize notification or any prize is returned as undeliverable, if Sponsor is unable to contact a potential WAHL Man of the Year Winner within a reasonable period, or if a potential WAHL Man of the Year Winner is found to be ineligible, declines the prize, or otherwise is not in compliance with these Official Rules, the prize may be forfeited, and the entrant with the next highest scoring entry for the same market may be declared a potential WAHL Man of the Market winner for that market, or the Sponsor may elect not to designate a WHAL Man of the Market for that market. WAHL Man of the Year Winner will be announced on or around January 20, 2014.
Prizes
Fifteen (15) WAHL Man of the Market Prizes: One (1) WAHL Lithium Ion+Ttrimmer (exact make and models to be determined solely by the Sponsor) and a $500 general use prepaid card. The approximate retail value (ARV) of the WAHL Man of the Market Prize is $569.99
One (1) WAHL Man of the Year Prize: In addition to the WAHL Man of the Market prize, the WAHL Man of the Year will receive a check in the amount of $1,000.00.
Total ARV of all prizes: $9,549.85
All Federal, State, and local taxes (including income taxes), duties, and the like, if any, are the sole responsibility of the winner. No substitution, assignment, redemption for cash, or transfer of any prizes permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value in the event that an offered prize becomes unavailable. Actual value of prizes may vary based on consumer electronic industry fluctuations. Winner will not receive difference between actual and approximate retail value.
Allow 8 to 10 weeks for shipment of all prizes. Sponsor shall not be held responsible for any delays in awarding any prize for any reason outside of their control. All prize details are at Sponsor's sole discretion. A prize will only be delivered to a verified Winner.
General
By participating in Contest, entrants agree to release and to indemnify and hold harmless Sponsor and its parent companies, affiliates, subsidiaries, retailers, franchisees, advertising and promotion fulfillment and/or judging agencies, and all of their respective officers, employees, directors, representatives and agents (individually and collectively "Releasees") from all liability, losses, claims, action, or proceedings, losses, any and all injuries and damages of any kind to person(s), including death or property resulting, in whole or in part, directly or indirectly, from entrant's participation in the Contest or any Contest related activities, or violation of intellectual property or personal rights (such as but not limited to, copyright, patent, trade name/trademark, and/or rights of privacy or publicity or portrayal in a false light) due in whole or in part to acceptance, possession, misuse or use of any prize; or participation in this Contest, or participation in any Contest related activity. By claiming a prize, the WAHL Man of the Market and Wahl Man of the Year winners agree to confirm that consent in writing upon request, to Sponsor and those acting pursuant to the authority of Sponsor, the right, in perpetuity, to the use of his name, voice, picture, image and/or likeness (and notwithstanding anything to the contrary in these Official Rules, WAHL Man of the Year Winner license the use of their photo to Sponsor, which may be altered, changed, modified, edited, used alone, together or with other works, and/or in distorted form, as solely determined by Sponsor) at any time(s) and in all media now known or hereafter discovered, worldwide, including on the Internet and World Wide Web, for advertising, commercial, trade and promotional purposes without additional compensation unless prohibited by law, and without notice, review or approval. Entrant agrees that submissions are gratuitous, unsolicited and without restriction, and will not place Sponsor under any obligation, and that Sponsor is free to disclose the ideas contained therein on a non-confidential basis to anyone or otherwise use the ideas without restriction and without any additional compensation to entrant. Entrant acknowledges that, by acceptance of his entry, Sponsor does not waive any rights to use similar or related ideas from any source. Any waiver of any obligation hereunder by Sponsor does not constitute a general waiver of any obligation to entrant. By entering, entrant acknowledges that Sponsor has no obligation to use or post any entry submitted and further agrees he will not post or publicly make any disparaging or negative comments about Sponsor or its parent, affiliates or subsidiaries, or any of their products on any web site or in any other type of media.
Limitations of Liability: Releasees are not responsible for lost, late, incomplete, damaged, inaccurate, stolen, illegible, delayed, misdirected, separated, or non-delivered entries; or for lost, interrupted or unavailable satellite, unavailable network, server, Internet Service Provider (ISP), Web site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, satellite, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network, including typographical, printing, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information with the administration of the contest, the processing or judging of entries, the tabulation of votes, the announcement of the prizes, the incorrect uploading of the photo or in any Contest-related materials. Releasees are not responsible for any incorrect or inaccurate information, whether caused by Web site users, or by any equipment or programming associated with or utilized in this Contest, and assume no responsibility for any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of Web site. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or operation of the Contest or Web site, to be acting in violation of the terms of the Web site or to be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. Releasees are not responsible for injury or damage to entrants' or any other person's computer related to or resulting from participating in this Contest or downloading, printing or copying materials from or use of Web site. If, for any reason, Contest is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes which, in sole opinion of the Sponsor, corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend Contest, and determine the winners from eligible entries received prior to action taken, or as otherwise deemed fair and equitable by Sponsor. In the event Sponsor does so, Sponsor shall post notice at www.wahlnation.com.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. IN NO EVENT WILL RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE WEB SITE OR DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID WEB SITE. JURISDICTION/CHOICE OF LAW: By entering, entrants agree that this Contest shall be governed by the laws of the State of Illinois, and agree to venue and jurisdiction solely in Whiteside County, Illinois for the resolution of any and all disputes.
WINNERS LIST: To view the WAHL Man of the Market or WAHL Man of the Year, log on to www.wahlnation.com. WAHL Man of the Market winners will be posted online as soon as winners are verified, but not later than January 15, 2014 and will remain online through March 31, 2014. WAHL Man of the Year Winner will be posted online on or about January 23, 2014 and will remain online through March 31, 2014.
